END-USER LICENSE AGREEMENT (EULA) PLEASE READ THIS SOFTWARE LICENSE AGREEMENT CAREFULLY. BY CONTINUING TO USE THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS: 1. License Dank Drone Downloader (DDD) is licensed under the "Attribution-NonCommercial-NoDerivatives 4.0 International (CC BY-NC-ND 4.0)" license. The full license terms can be found online at CC BY-NC-ND 4.0 Legal Code. Attribution: You must provide appropriate credit, include a link to the license, and specify if any changes were made to the software. This credit should be given in a reasonable manner, avoiding any implication of endorsement by the licensor mentioned below. NonCommercial: You are prohibited from using the software for commercial purposes. It's important to note that accepting donations for projects that use DDD as a component constitutes commercial use. NoDerivatives: You may not distribute modified versions of the core DDD application or any of its indexed files or assets without prior consent. 2. Exceptions The licensor may grant exceptions to the above licensing terms. You must obtain explicit permission from the developer via email at contact@dankdronedownloader.com for any exceptions. 3. Disclaimer You acknowledge and agree that your use of this software is at your sole risk, and all associated risks are your responsibility. The application is provided "as is," with all faults, and without any warranty of any kind. 4. Files & Release Notes Files and release notes are also provided on an as-is basis and no guarantee is made that these files can be used with any available software. DDD is a file archival service and nothing more. 5. License Terms The license terms may be modified at any time without prior notice. It is your responsibility to ensure compliance with both current and future license terms. 6. Limitation of Liability In no event shall the developer or anyone associated with DDD be liable for personal injury or any incidental, special, indirect, or consequential damages, including, but not limited to, damages for loss of profits, loss of data, damages or losses, arising from or related to your use or inability to use the software. 7. Legal Proceedings You agree not to initiate any legal proceedings against the developer or anyone associated with DDD. 8. Data Collection While using DDD, the software may request personally identifiable information that could be used to identify you. Usage Data, including your device's Internet Protocol address, visit timestamp, unique device identifiers, and other diagnostic data, may be collected automatically. This data is solely for the purpose of providing and maintaining our services, monitoring usage, and may be used for data analysis, identifying usage trends, and improving our service and user experience. We will never share your personal information with any third party unless required by law enforcement agencies with jurisdiction in your country. 9. Liability Disclaimer If this software inadvertently causes damage to your computer, harm to you, or any unintended consequences, including but not limited to damage or inoperability of your drone or associated hardware, it is your sole responsibility. By using this program and any content downloaded through it, you assume all associated risks. 10. DDD Credits Purchase and Use DDD Credits can be purchased at a rate of 1 Credit/1 GBP. All purchases of DDD Credits are final and non-refundable. Nature of Credits DDD Credits are a digital product and do not hold any monetary or cash value outside the platform. DDD Credits cannot be transferred, resold, or exchanged for cash, goods, or services outside of their intended use on the platform. Expiration and Usage DDD Credits do not expire and will remain valid for use unless terminated under this agreement or the platform is discontinued. Users are encouraged to utilize their Credits in a reasonable timeframe, as the platform reserves the right to adjust its services or pricing at any time. User Responsibility Users are responsible for maintaining the security of their accounts and DDD Credits. The platform is not liable for any unauthorized use or loss of Credits due to compromised account access. Platform Adjustments and Discontinuation The platform reserves the right to modify or discontinue services, including the use and functionality of DDD Credits, with reasonable notice provided to users of at least 30 days unless in a force majeure event. In the event of platform discontinuation, unused Credits will not be redeemable or refundable, however prior notice will be given. Misuse and Violation of Terms Any misuse of the platform or violation of these terms may result in the forfeiture of DDD Credits without compensation and your access to the system as a whole being blocked. The platform reserves the right to suspend or terminate user accounts found in breach of these terms. Pricing and Conversion Adjustments The platform reserves the right to adjust the pricing or value of DDD Credits at its discretion, with prior notice to users. Limitation of Liability The platform is not responsible for technical issues, errors, or outages that may temporarily prevent the use of DDD Credits. Users agree that the platform�s maximum liability for any claim related to DDD Credits is limited to the original purchase value of unused Credits. Payment Provider Claims If a user believes there has been an error in payments or credits, they are encouraged to contact us directly via the email provided in the app to resolve the matter amicably. We maintain detailed records of all transactions and will work diligently to address any legitimate concerns. Users who file fraudulent payment disputes may have their access to the DDD service terminated, subject to a review of the circumstances. Please note that users retain their rights to raise payment disputes with their payment provider as allowed by law. Enjoy using DDD responsibly. Cs2000
